Welcome to Nimbiq. Please read these Terms of Service carefully before accessing or using our services, website chatbot widgets, and administrative systems.
1. Agreement to Terms
By accessing or using our services, you agree to be bound by these terms. If you do not agree to all terms, you may not access or use our services.
2. Staff SMS Alerts
Nimbiq may provide optional Staff SMS Alerts for business customers who choose to receive internal notifications when a website chatbot lead is captured.
Staff SMS Alerts are optional. Businesses may continue to use Nimbiq email alerts and dashboard lead records without enabling SMS alerts.
Staff SMS Alerts are sent only to authorized staff recipients who opt in through a Nimbiq consent form. Message frequency varies based on website lead activity.
Staff SMS Alerts are transactional internal business notifications. They are not marketing messages and are not sent to website visitors, prospects, patients, or consumers.
Message and data rates may apply. Staff recipients may reply STOP to opt out or HELP for assistance.
Text messaging originator opt-in data and consent will not be shared with any third parties.
Nimbiq does not guarantee delivery of SMS alerts. Wireless carriers and messaging providers are not liable for delayed or undelivered messages and may delay, block, or filter messages. Lead records available in the Nimbiq admin dashboard and email notifications should be treated as the primary record of captured leads.
Staff SMS Alerts should not be used for emergencies, diagnosis, treatment advice, insurance verification, appointment confirmation, or payment processing.
SMS alert consent is not a condition of purchasing or using Nimbiq services.

3. Use of Chatbot Widgets
Nimbiq provides AI-powered website assistants that use configured knowledge bases and prompts to help visitors find information and connect with your business. Our widgets are intended to support lead capture and basic information retrieval. Customer chatbots are explicitly restricted from collecting Protected Health Information (PHI) or processing clinical or financial transactions.
Assistant responses are generated automatically and may be incomplete, outdated, or inaccurate. AI may make mistakes. The assistant is not a substitute for professional medical, legal, financial, or clinical advice.
For healthcare and other regulated industries, the assistant does not provide diagnosis, treatment recommendations, insurance guarantees, or emergency guidance. Visitors experiencing a medical emergency should call 911 or their local emergency number immediately.
Unless your widget is explicitly configured to do so, the assistant does not book, confirm, or guarantee appointments, availability, pricing, or other commitments. Visitors should verify important details directly with your business by phone, in person, or through your official website.
Business customers are responsible for reviewing and maintaining their knowledge base, prompts, and widget configuration, and for deploying the assistant in a manner appropriate to their industry and audience. Nimbiq is not responsible for business decisions or visitor actions taken based on assistant responses, as further described in Section 4.
4. Limitation of Liability
In no event shall Nimbiq, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, including damages arising from reliance on AI-generated assistant responses, missed or incorrect lead information, or actions taken by website visitors or business staff based on chatbot output.
